Licensing Agreement

1. Scope and parties

This licensing agreement governs the use of the Lingly app. It is concluded between you and Lufy Studios, Luis Fynn Schenk — not with Apple. By downloading, installing or using the app you agree to it. If you do not agree, please do not use the app.

2. What Lingly is

Lingly is a language course for German and Turkish in both directions. It covers levels A1 to B1 and consists of vocabulary lessons, grammar topics with exercises and rule prompts, reading texts, writing tasks, speaking exercises and guided conversations. The content lives in the app; no internet connection is needed in order to learn.

3. Licence granted

You receive a non-exclusive, non-transferable, revocable right to use Lingly on the Apple devices that you own or control, within the App Store Terms of Service. Use for your own learning is permitted, privately as well as professionally. Not permitted: reproducing or passing on the content, incorporating it into other offerings, renting or selling the app, reverse-engineering it, or circumventing its technical protection measures.

4. Account

An account via “Sign in with Apple” is optional. The app works fully without one; your progress then stays on that single device. You are responsible for the security of your Apple ID. We do not offer sign-in with an email address and password.

5. Free use and Lingly Pro

The course is fully accessible free of charge. Without a subscription you learn with a limited number of hearts: a mistake costs a heart, spent hearts grow back by themselves after a short time, and some of the guided conversations are reserved for Pro. The free version is also supported by advertising — as an ad slot on some screens and, at most once a day, as a full-screen ad after you have completed a lesson. How this is handled is set out in the Privacy Policy.

If you are out of hearts, you can earn one back up to three times a day by voluntarily watching a short video. You do not have to; it is an option alongside waiting and subscribing.

Lingly Pro removes these limits: no advertising, learning without hearts, access to all conversations, and every conversation either typed or spoken. A monthly and an annual subscription are offered; the annual subscription is preceded by a free trial week. The prices that apply are shown in the app and in the App Store and may vary by country.

6. Renewal, cancellation, refunds

The subscription renews automatically for the same period unless you cancel at least 24 hours before it ends. Billing runs through your Apple ID. You can manage and cancel it at any time in your Apple account settings or in the app under Profile → Subscription; cancellation takes effect at the end of the current period. If a free trial is not cancelled before it ends, it converts into a paid subscription.

Apple handles purchase and billing. Refunds are therefore governed by the App Store terms and must be requested from Apple, not from us. Statutory rights, in particular a right of withdrawal for digital content, remain unaffected.

7. Content and copyright

Course texts, exercises, design and program code are protected by copyright and belong to Lufy Studios. What you write in the app belongs to you; we do not process it and do not see it, because it never leaves your device and your iCloud.

8. Not a substitute for lessons

Lingly replaces neither lessons nor exam preparation, and does not prepare you for any particular examination. We take care over the content, but we cannot guarantee that every sentence is linguistically flawless, and no particular learning outcome can be promised. We welcome reports of mistakes.

9. Third-party services

The app uses iCloud to sync between your devices, Apple’s services for speech recognition and speech output, and the App Store for purchases. We cannot vouch for their availability or function; Apple’s respective terms apply.

10. Warranty

The app is provided as is. We do not warrant that it will be error-free or continuously available. Statutory warranty rights remain unaffected. Should the app be defective, you may notify Apple; Apple may refund the purchase price. Beyond that, Apple has no warranty obligation to the extent permitted by law.

11. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only for breach of material contractual obligations, and limited in amount to the foreseeable damage typical for this type of contract. We, not Apple, are responsible for claims relating to the app — including product liability, consumer protection and infringement of third-party rights.

12. Maintenance and support

We alone are responsible for maintenance and support. Apple has no obligation in this respect. You can reach us at info@lufystudios.de or in the app under Settings → Help.

13. Export compliance

You represent that you are not located in a country subject to a United States embargo or designated by the U.S. Government as a country supporting terrorism, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

14. Termination

You can stop using the app at any time, delete it, and remove your account in the app under Profile → Delete account. In the event of serious breaches of this agreement we may block access. A running subscription is unaffected and must be cancelled through your Apple ID.

15. Changes

Content and features continue to develop. We may adapt this agreement where there is a proper reason to do so; the version in force is shown in the app and on our website, and the date at the top is updated accordingly.

16. Governing law

German law applies, excluding its conflict-of-law rules. Mandatory consumer protection provisions of your country of residence remain unaffected.

17. Apple as third-party beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance, Apple has the right to enforce this agreement against you.
